On Friday, the news that a tentative agreement was reached to open the government until February 15th was indeed good news for those 800,000 federal workers.
The President realized that if the shutdown continued, the safety of the nation might be at risk and thus compromised with the Democrats — with a promise to negotiate the critical issue of comprehensive border security, including building some type of barrier, fencing or wall.
In his brief “rose-garden” speech, the President indicated that border security experts would be preparing ideas for how best to secure the border.
However, any reasonable individual witnessing the antics within the House, must acknowledge the President has moved decidedly towards the Democrats in attempting to reach a deal regarding border security.
His latest proposal asking for a “large down payment” on border wall funding, actually eliminated the President’s demand for the $5.7 billion, in order to get Nancy and company to negotiate in good faith, was once again rejected by the House Speaker. Moreover rudely dismissing the President’s offer as a “nonstarter” saying it was “not a reasonable agreement.”
Adding, “I don’t know if he knows what he’s talking about.”
Which brings us back to reality and the likelihood that the next 3-weeks in all probability will be a waste of time for the President, regarding how serious Democrats are in giving him the funding for the wall.
The President risking his own political capital with his base has continually reached out to both Schumer and Pelosi, hoping to strike a bipartisan solution in a spirit of cooperation. Only to be rejected time and again.
However, Senator Lindsey Graham indicated moments after the President’s rose-garden speech that if Democrats go-back on their word during this brief window, the President will finally “pull-the-trigger” and declare a “National Emergency.”
The White House has been burning the midnight oil in making sure the President can tap into an emergency 7 billion dollar fund pertaining to the crisis at the border, and has been assured by legal counsel that he has the absolute authority under both the “Immigration and Nationality Act” and the “Authorization and Appropriations Act-404” to declare a “National Emergency.”
Moreover aside from the obvious invasion by thousands of un-vetted illegal aliens threatening the sovereignty of our nation, the humanitarian suffering from migrants on the Mexican side of the border, along with perhaps the biggest crisis of all, the influx of drugs pouring into America, assures the President he’s on solid Constitutional ground.
However, that won’t stop the radical left from seeking a temporary injunction from perhaps the 9th Circuit to stop the administration.
Reports have surfaced that the President as already drafted an emergency proclamation, which in parts reads.
“The massive amount of aliens who unlawfully enter the United States each day is a direct threat to the safety and security of our nation and constitutes a national emergency,” a draft of a presidential proclamation reads. “Now, therefore, I, Donald J. Trump, by the authority vested in me by the Constitution and the laws of the United States of America, including the National Emergencies Act (50 U.S.C 1601, et seq.), hereby declare that a national emergency exists at the southern border of the United States.”
To bolster his case the President can easily reference a 2014 report from the leftist Huffington Post citing their data that almost 80% of women and girls attempting to make the dangerous journey to the United States are raped or sold on the black market.
The President can also cite the 266,000 arrests of criminal illegal aliens, the 100,000 assaults, the 30,000 sex crimes and the 4,000 murders committed by criminal illegal aliens in the United States, along with the tens of thousands of lesser crimes.
According to the experts, the administration could pull $681 million from Treasury forfeiture funds, $3.6 billion in military construction, an additional $3 billion in Pentagon civil works funds, and $200 million in Department of Homeland Security funds.
If the declaration is made, the US Army Corps of Engineers would immediately be deployed to the border to construct the wall, some of which could be built on private property, which would require the President to use the “Eminent Domain” law.
