On June 17, 2019, Democratic New York Governor Andrew Cuomo signed legislation that lets illegal immigrants get a state driver’s license, county clerks. The new “Driver’s License Access and Privacy Act” was sold to voters as a way “to provide for the licensure of drivers in order to enhance public safety.”
The Green Light Bill, as it is called, passed the New York Senate in a matter of hours and was passed quickly by the state assembly.
Erie County Clerk Michael “Mickey” Kearns wrote a letter to Erie County Attorney Michael Siragusa asking him to represent the side of federal law supporters in court. The clerk began:
“As I understand it, this Act requires that, as an agent of the Department of Motor Vehicles, I will be compelled to give driver’s licenses to illegal immigrants.
“I will not be granting driver’s licenses to illegal immigrants.”
Kearns stated that, as a county clerk, he had sworn an oath to support the U.S. Constitution and the New York Constitution. “After a review of this Act, I am convinced that it is inconsistent with federal law,” wrote the New York official.
The biggest concern for Kearns and other New York licensing clerks was the threat of being sued no matter what they did:
“More important, however, complying with the Act puts me and other County Clerks in the untenable position of having to decide whether or not to uphold federal law or the newly enacted state law. I anticipate being sued in either event.”
Kearns closed his missive by asking the county attorney for representation in the lawsuit that will result from a declaratory action Kearns intends to file as a legal challenge in U.S. District Court to declare the Green Light Law unconstitutional.
New York is the 13th U.S. state, plus the District of Columbia, to allow undocumented immigrants to apply for licenses.
Jennifer Connor helped organize the Green Light Campaign which was unpopular with 53 percent of New Yorker voters, according to a Siena Poll conducted in June 2019. Connor explained that more than half of her state’s compatriots are delusional and mentally unbalanced:
“The only reason to be against this all along has been xenophobia and fear.”
After the New York Senate approved the Green Light Bill, senator Gustavo Rivera (D-Bronx) resorted to a propaganda tactic called bandwagoning (“We’re all alike so jump on the bandwagon with us!”) when he addressed the house floor:
“As New Yorkers, we have an obligation to defend other New Yorkers. And every one of these individuals, whether they’re documented or not, are New Yorkers.”
Indeed. Illegal New Yorkers. But defend them against what? Federal law.
Naturally, the law is “for the children.” Senator Luis Sepulveda (D-Bronx), the bill’s original sponsor stood with his young son on the Senate floor after the law’s passage and told all the illegals in attendance and throughout the state:
“We see you. We welcome you with open arms. You are here, and today we give you the right to move freely around this state without fear.”
New York’s Democratic leaders want their state to join nine others opposing federal immigration policies by sheltering illegal immigrants instead of holding them accountable for breaking the law. Under the cloak of humanitarian relief, liberal cities, counties, and states are protecting undocumented residents who are prized as valuable future left-leaning voters.
California, Colorado, Connecticut, Illinois, Massachusetts, New Jersey, New Mexico, Oregon, and Vermont are already considered Sanctuary States that “have laws, ordinances, regulations, resolutions, policies, or other practices that obstruct immigration enforcement and shield criminals from ICE — either by refusing to or prohibiting agencies from complying with ICE detainers, imposing unreasonable conditions on detainer acceptance, denying ICE access to interview incarcerated aliens, or otherwise impeding communication or information exchanges between their personnel and federal immigration officers.”
By granting citizen rights to non-citizens, sanctuary communities – which are invariably dominated by Democratic officials – the Left can build its election base for the 2020 presidential run-off. Sweeping new laws are giving away citizenship rights and privileges are basically forward-paying bribes to the newcomers who hail, by a vast majority, from impoverished, undereducated third-world countries.
California gives away Medicaid money to illegals. Governor Gavin Newsom recently signed a controversial new law that allows illegal residents to serve on government boards and commissions, effective January 1, 2020. Several legal actions to remove him from office are pending.
In New York, clerks in Rensselaer, Niagara, Chautauqua, and Allegany Counties are refusing to comply with the law. Frank Merola, Rensselaer County Clerk, said:
“I go back to the Constitution. You’re not supposed to help or aid anybody if they’re here illegally, especially if we know that.”
Allegany County Clerk Robert L. Christman stated that he would turn over any undocumented driver’s license applicant to U.S. Immigration and Customs Enforcement (ICE):
“If you come into my facility and you have done something illegal, it is my obligation to report you to the appropriate authorities, whether you’re a citizen or not.”
